Where Do We Go From Here?
The 2011 decision of the Court of Appeals strikes down the 2010 Summary Judgement Ruling which favored Red Slab and Provo City — two entities determined to save Rock Canyon. Consequently, the issue of ownership cannot be resolved with a full trial.
The Court of Appeals decision does not mean that the Davis family has the right to carry on mining activities in the canyon. That issue will be determined by the family’s ability to obtain mining permits and a Conditional Use Permit from Provo City. It is the hope of the Rock Canyon Preservation Alliance that a settlement can be reached which will satisfy all parties involved.
