The 2011 deci­sion of the Court of Appeals   strikes down the 2010 Sum­mary Judge­ment Rul­ing which favored Red Slab and Provo City — two enti­ties deter­mined to save Rock Canyon. Con­se­quently, the issue of own­er­ship can­not be resolved with a full trial.

The Court of Appeals deci­sion does not mean that the Davis fam­ily has the right to carry on min­ing activ­i­ties in the canyon. That issue will be deter­mined by the family’s abil­ity to obtain min­ing per­mits and a Con­di­tional Use Per­mit from Provo City. It is the hope of the Rock Canyon Preser­va­tion Alliance that a set­tle­ment can be reached which will sat­isfy all par­ties involved.
